Question: How would you like to lease a car for $200 a month with a contract that has unlimited mileage, however after 200 miles of driving, the car's maximum speed decreases to 45 miles per hour until your next payment? Lets go further and say the manufacturer's reason for reducing the top speed of the car is "to proactively address potential network congestion due to increasing demand" of the roadways. And here is the kicker, the car company's advertisement campaign states that its the fastest around. Can you see the correlation between my situation with AT&T slowing my data speeds and the hypothetical situation above? Can you see how this is not fair? I have an unlimited data plan for a reason. I use it a lot of data. When I pay for a service (or a car), I have expectations to the services being promised. I know of your disclosures stating that "service may be interrupted, delayed, or otherwise limited for a variety of reasons, including… system capacity…", however the practice of slowing down my internet speed is a violation of FCC 10-201, section III, 2010. It sets up the guidelines on Internet openness disclosure and reasonable network management which governs data communications such as this.

Before you made this restriction to block FaceTime on iPhones, all my friends had AT&T... after the blockage they went and got their phones unlocked and switched to T-Mobile and signed up for unlimited data. This is unacceptable I thought it was bandwidth problems or something along those lines. Data is data I should be able to tether my phone to my ipad with my UNLIMITED data plan with no additional cost, I should be able to facetime wherever I am! Weather I am on my Ipad that is tethered to my iphone on the UNLIMITED data plan. See a pattern here? Question: How would you like to lease a car for $200 a month with a contract that has unlimited mileage, however after 200 miles of driving, the car's maximum speed decreases to 45 miles per hour until your next payment? Lets go further and say the manufacturer's reason for reducing the top speed of the car is "to proactively address potential network congestion due to increasing demand" of the roadways. And here is the kicker, the car company's advertisement campaign states that its the fastest around. Can you see the correlation between my situation with AT&T slowing my data speeds and the hypothetical situation above? Can you see how this is not fair? I have an unlimited data plan for a reason. I use it a lot of data. When I pay for a service (or a car), I have expectations to the services being promised. I know of your disclosures stating that "service may be interrupted, delayed, or otherwise limited for a variety of reasons, including… system capacity…", however the practice of slowing down my internet speed is a violation of FCC 10-201, section III, 2010. It sets up the guidelines on Internet openness disclosure and reasonable network management which governs data communications such as this.

I am a long time customer, I do not abuse your network with my unlimited data plan. Why am I being singled out to not be able to facetime over cellular networks? This is a gross violation of the Net Neutrality rules. You can assuredly offer plans that cahrge more for more data, and you can certainly curb the appetites of a few who do abuse your networks with unlimited data plans, but to deny me particular IP traffic on an internet connection is just plain wrong. When our plans are up, we'll be looking for a provider that understands what net neutrality means and is committed to it's principles, not just offering lip service to quell public opinion. This is wrong, and I hope that you see that and change this policy soon.
